The Association of Voice-Over Artistes(AVOA) comprises of men and women who provide voice work on broadcast materials to media industry, which include but is not limited to:

    • voice work on broadcast/advert materials, Interactive Voice Response (IVR), computer software and documentaries.
    • advert copywriting and translation,
    • program presentation and periodic modeling

AVOA hereby stipulates that the terms and conditions under which their members shall render service shall be as follows:

    • Jobs are executed and services contracted exclusively on the terms and on conditions stated herein, without any variation or waiver of any clause or portion therein. The Association further reserves the right to review these conditions and shall communicate any review to all parties, who shall be bound thereby, from the date of such review.
    • The Association accepts jobs and services on the basis that the conditions below are fulfilled and the customer irrevocably warrants that they are fulfilled.

These are:

a. That the client is the owner of the work, and where he is not, is the fully authorized agent for the owner of the work or any person(s) with recognized legal interest in the work.  

b That the work sought to be produced does not compromise or contravene any present law in force or regulation of any agency governed by law for the time being in force, and that no part of the work sought to be produced infringes on the rights of any party whose consent, license or authorization has not been obtained.

  • that the work does not include any inciting, libellous or defamatory material.
  • that the work sought to be produced is not such that may cause public disaffection or private injury.
  • That neither the work nor any part or portion of it contravenes any law, regulation or statute of any federal, state or local government of any country from or in which the jobs would be flight.

The client shall pay the prescribed or reviewed tariff for jobs done, at the point of production or 30 (Thirty) days after production before it is flight or aired.

It is further stipulated that;

 
  • All voice over jobs, irrespective of any duration, including payoffs shall attract full fees
  • Commercials may be flight or aired for an initial period of 12 (twelve) months and if used for any period thereafter, shall attract a minimum payment of 50% of the fees originally charged for the job, for every 6 (six) months, or any lesser period.
  • Translations and scripting shall attract full fees, except where such is rejected by the client, in which case 50% of the full fee shall be paid by the client as rejection fee.
  • All voice additions, alterations, modifications, amendments and dubs on pre-flight works shall attract 50% of the full fee, while those on already flight work attract full fees.
  • Where different addresses are dubbed onto a commercial, such that each address on the commercial forms a whole, other pre-recorded voices on such work must be paid full fees on each commercial carrying a different address.
  • Television voice-over attracts different fees from Radio voice-over. Where a voice-over is used for both television and radio commercials, the two applicable fees shall be paid for the same job.
  • Where a work requires more than one language, full fees shall be paid for each of the various languages voiced.
  • Fees chargeable for voice are separate from fees chargeable for singing on or appearing in commercials.
  • Fees shall be negotiated separately for interactive voice response (IVR) jobs, including PABX, telephony and telephone, banking, documentaries, informatials and periodic modeling.
   
4 If for any reasons there are monies left outstanding to be paid in respect of any jobs, the Association or its members shall be entitled to interest at 3.0% over the interbank base rate prevailing at that time calculated on a daily basis on all amounts overdue to the Association or its members. No deductions or retentions shall be made by the client on account of any alleged claims against the association or its members for compensation or otherwise.
   
5 The Association shall not be liable for any loss, damage or delay of any kind whatever caused by force majeure or an act of God, unavoidable by an exercise of due care and utmost sense of responsibility.
   
6 The client agrees that the terms and conditions of service herein provided shall extend to indemnify the members of the association and shall be enforceable by the association for itself and as trustee or agent for its members.
   
7 All reports of indiscipline or professional misconduct by a member of the Association shall be reported to the association within seven (7) working days of the occurrence of such act.
   
8 Any dispute arising out of or in connection with the terms and conditions stated herein, its interpretation or any matter related thereto, between the parties shall in the first instance be referred to a single arbitrator agreeable to both parties, and in the event that they are unable to agree, an arbitrator shall be appointed for that purpose by the Chief Judge of Lagos State. The arbitration proceedings shall as much as possible be conducted in accordance with the arbitration law, for the time being in force in Nigeria.
   
9 This contract shall be governed by laws of the Federal Republic of Nigeria.
   

DEFINITIONS

In these conditions:

  • AVOA means ‘Association of Voice over Artistes; ‘The Association’ or its members.
  • Job/Work means any particular service of the Association (as in 1 above) or other voice services requested by customers.
  • Flight means the airing or transfer over a sound medium of any job requested by a customer.
  • Voice Over means any voice work capable of being transferred from one sound medium to another sound medium.
  • Demo means demonstration copy
  • Dub means add or transfer.
